These terms form an agreement between you and Alarm24 covering the Alarm24 iPhone app and this website. By downloading or using the app, you accept them. If you do not accept them, do not use the app.
Section 5 sets out real limitations on what any alarm app running on iOS can guarantee. Please read it, because it matters more than the rest.
1. Licence to use the app
We grant you a personal, non-exclusive, non-transferable, revocable licence to use Alarm24 on Apple-branded devices that you own or control, as permitted by the Usage Rules in Apple's Media Services Terms and Conditions. This licence gives you a right to use the app; it does not transfer ownership of it.
You may not copy, redistribute, sell, rent, sublicense, reverse-engineer, decompile or attempt to derive the source code of the app, except to the extent that applicable law expressly permits it despite this restriction.
2. Price
Alarm24 is free. There are no in-app purchases, no subscriptions and no advertising. If we ever introduce a paid feature, it will be announced in advance and will not remove anything that is free today for existing users.
3. Acceptable use
You agree not to:
- use the app in any way that breaks applicable law;
- interfere with, disrupt or attempt to gain unauthorised access to the app or its verification mechanisms;
- use the app in an environment where its failure could lead to death, personal injury, or severe physical or environmental damage.
4. Missions and emergency recovery
Alarm24 is designed so that a ringing alarm cannot be stopped from inside the app until the wake-up mission you configured has been completed and verified. That is the entire purpose of the product, and by using it you accept it as intended behaviour rather than a defect.
An emergency recovery path exists: holding the emergency control for ten seconds opens a harder mission. It does not silence the alarm. You are responsible for choosing missions you can realistically complete, for example not setting a photo mission for a location you will not be able to reach.
The app cannot prevent you from uninstalling it or from turning off your device, and it does not attempt to.
5. Important limitations, please read
Alarm24 is a consumer convenience app. It is not a safety-critical system, not a medical device, and not an emergency notification service. It is not certified for any use where failure to wake could cause harm.
Do not rely on Alarm24 as your only means of waking for anything with serious consequences, such as medication schedules, safety-critical work, medical appointments, flights, or driving. Always keep a second, independent alarm for those.
An alarm on iOS depends on conditions outside our control, and it may not ring if:
- the device is switched off, out of battery, or restarts at the wrong moment;
- notification or alarm permission has been denied or later revoked in Settings;
- you are running iOS 15 to 25, where Compatibility Mode relies on notifications that the system can suppress in some configurations;
- Focus, Do Not Disturb, Silent mode, Low Power Mode or Screen Time are configured in a way that suppresses delivery;
- the device volume is set to zero or the device is connected to an external audio output;
- iOS terminates or throttles the app, or a future iOS update changes alarm behaviour;
- the device's date, time or time zone is incorrect.
6. No warranty
To the fullest extent permitted by law, the app is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that it will wake you on any given morning.
Nothing in these terms excludes or limits your mandatory rights as a consumer under EU law, including the statutory conformity rights that apply to digital content.
7. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect or consequential loss, including missed appointments, missed flights, lost income, disciplinary action, or any other consequence of oversleeping.
Nothing here limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any liability that cannot lawfully be limited. Because the app is provided free of charge, our total aggregate liability to you is limited to the amount you paid for it, which is nil, except where the law requires otherwise.
8. Apple-specific terms
These terms are between you and us only, not with Apple. We, and not Apple, are solely responsible for the app and its content.
- Apple has no obligation to provide any maintenance or support for the app.
- If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the app.
- We, not Apple, are responsible for addressing any claim relating to the app, including product liability claims, any claim that the app fails to conform to a legal or regulatory requirement, and claims arising under consumer protection or privacy law.
- If a third party claims the app infringes their intellectual property rights, we, not Apple, are solely responsible for the investigation, defence, settlement and discharge of that claim.
- You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these terms and, upon your acceptance, will have the right to enforce them against you.
- You must comply with any applicable third-party terms of agreement when using the app.
9. Changes and availability
We may update the app and these terms. Material changes to the terms will be reflected here with a new date, and where the change is significant we will note it in the App Store release notes. Continuing to use the app after a change means you accept the revised terms.
We may discontinue the app. If we do, alarms already on your device will continue to work for as long as your device and iOS version support them.
10. Governing law
These terms are governed by the law of the Netherlands. If you are a consumer, mandatory consumer law entitles you to bring proceedings in the courts of your country of residence, and we do not seek to restrict that.
If you are a consumer in the EU, you may also use the European Commission's online dispute resolution platform, though we would much rather you simply emailed us first.
